Constitutional Law of the Magical Democracy

Preamble:

The Magical Democracy was founded by DrThestral on February 17, 2022. It was founded after a big magical tree at the edge of the forest just outside the UAF territory started to sparkle and bring its magic into the world of the Waffles SMP. From there it started to spread and it made its way up to a small cabin where DrThestral lived, and turned it into an enchanted place full of magic and fantasy. In return DrThestral made a community with people who swore to help each other and where everyone is equal. Together they created homes across the land and made little places to worship this magical tree.

Article I.

Name

The name of this nation shall be Magical Democracy, named after both the magic which created the bond of these beautiful people and the government form which the nation shall strife to live up to.

Article II.

Purpose

The nation was founded with the idea of people helping each other when needed and creating beautiful things with groups of people from all over the world. If necessary, the members of the Magical Democracy will combine their strengths and face any danger headed their or any of their allies way. Apart from that the Magical Democracy will be a peaceful group of people who worship the magical tree that brought all of them together.

Article III.

Membership

Being a member of the Magical Democracy has no restrictions on locations where you can set up camp or build your base, neither has it restrictions on how this base should look. There are also no taxes in the Magical Democracy. Membership of this nation does mean however that when someone from the country or any of the allied countries is in need, you won’t hesitate to help them out without expecting to be rewarded for it. Also, when the Magical Democracy is at war with another country, you may be called upon to help. This can be either through fighting in the war itself, or by donating equipment.

Article IV.

Organization

Section I. Structure

Every decision in the government will be made through the Magical Council Gatherings. In these gatherings, the Ministers of the Magical Democracy will decide on certain matters and decide what will happen within the country. This happens through voting and any change only passes when at least three out of the four ministers vote in favour. If a change which can affect the nation on a massive scale, the Representatives of the People of the Magical Democracy will have to vote on the matter as well and a change only passes when four out of the six representatives vote in favour.

Section II. Roles

The government of the Magical Democracy exists out of five roles.

The highest role is called the Prime Minister of the Magical Democracy. This is the person who represents the Magical Council and brings the news and changes the council has voted on to the citizens of the Magical Democracy. When the Magical Council has declared a state of direct long-term crisis, the Prime Minister has the permission to push changes and laws without the council having to vote about it, as long as the prime minister reports to the council about these changes and laws.

The second highest role is called a Minister of the Magical Democracy. There are four ministers and each one gets to participate in the Magical Council Gatherings. They talk and vote about new laws and changes which can be made to the Magical Democracy.

The third role is called a Representative of the People of the Magical Democracy. There are six representatives and when a big change is going through the Magical Council any representative can request a motion of doubt and then the other representatives must vote to either accept or decline it. If four out of six representatives vote to accept the motion, the change goes back to the council and there the ministers will have to adjust their plans and submit it back to the representatives. If they accept the new submission the change has officially passed, but if they decline the new submission the change goes back to the council and they will have to make adjustments again.

The fourth role is called Assistant. There are between zero and four assistants, and every assistant is assigned to one of the ministers. Every minister can choose their own assistant and an assistant must agree with being an assistant and can’t be forced in the job. They help their minister out if they need help with brainstorming, or if they must come up with arguments to (not) do something for in the Magical Council Gathering, etc. Assistants don’t need to be on the WSMP, so they can also be a close friend or family member of the minister. Every minister can only have one assistant and not every minister has to have one.

The fifth role is called Counselor. There is either no or one counselor. The Magical Council gets to choose a counselor, but is not required to do so. The counselor has to be someone who is not also a representative/assistant and it can’t be a friend or family member of one of the ministers. This must be someone who can look to the subject from a neutral standing point. When a representative doesn’t trust the council on its own but hasn’t got evidence of corruption, they can request a motion of counsel. If this passes, the council is obligated to appoint a counselor.

Section III. Elections

The Magical Democracy is a democracy. This means that civilians can have an influence on what happens within the country. This happens through voting. Every three months citizens get one week to put themselves up for election if they want to be in the government. After that week, they have two weeks to show what they can do for the nation and why people should pick them. Then, there will be two days to vote for who you want to be in the government. Candidates can vote as well, but not on themselves. If they get caught voting on themselves, by using an alt account for example, they will be disqualified and they can’t rerun ever again. After the voting, 20% of the candidates, with a minimum of ten people, will go to the second round. In this round they have five more days to show what they can do before people will be able to vote again. After that voting, only ten people remain. These ten people choose four among them to be the ministers, the rest will become representatives. Then the ministers will choose one among them to be the premier.

Section IV. Motions

Not all the power lies at the Magical Council. The representatives have a way to defend the things they believe as well, through the power of motions. Any one representative can request any motion and the other representatives will have to vote about it. If four out of six vote in favour the motion is accepted and will automatically be executed. There are four motions the representatives can make use of.

The motion of doubt can be requested after the Magical Council announced a new law or change they’ve settled on. If this motion gets accepted, the law or change goes back to the Magical Council in which the ministers will have to alter certain things to it and after that resubmit it to the representatives, who get to vote on it as well.

The motion of counsel can be requested at any time and if this motion gets accepted, the Magical Council is forced to appoint a Counselor to counsel the ministers during the Magical Council Gatherings.

The motion of disbelieve can be requested at any time and if this motion gets accepted, the Magical Council has to change the way they act, for if they don’t the next motion will be a motion of distrust. This motion a warning motion and has no direct consequences for the Council.

The motion of distrust can be requested at any time and if this motion gets accepted, the Magical Council will be dissolved and a direct re-election of the entire Magical Council will take place. A motion of disbelieve must have preceded a motion of distrust at any time.

Article V.

Quorum

For the elections to be valid, at least sixty percent of the population who have been online on the WSMP within the past ten days must have voted. If this quorum hasn’t been reached all the votings will be declared invalid and a new voting period will be set up.
For votings inside the Magical Council and among the representatives to be valid everyone must have voted. If this quorum hasn’t been reached all the votings will be declared invalid, a new voting period will be set up and everyone who hasn’t voted will be noted. If someone from the council hasn’t voted for four times within one term, they will be released from the Magical Council or the representatives.
